Eminent domain case settled

The Maine Department of Transportation has settled a long-running eminent domain lawsuit.

The state agreed to pay $725,000 to the owners of the Sail Inn Restaurant in Prospect to settle a case based on the department's taking of the property by eminent domain in 2003 to construct the Penobscot Narrows Bridge, the Bangor Daily News reported. The department paid the Dyer family, which had run the Sail Inn for 50 years, $225,000 for the five acre property, but the Dyers challenged the appraisal and eventually appealed for up to $2 million for the property.

Both sides have been locked in protracted litigation for years over the matter, and the settlement is the result of court-ordered mediation in September, according to the paper.
