Jasper Wyman & Son has filed a federal lawsuit against its insurance company, claiming the insurer failed to cover all related costs from accidental contamination of blueberry shipments.
The Bangor Daily News reported the insurer, Houston Casualty Co., acknowledged some of the company’s claim is covered but contests more than $300,000 of Wyman’s losses. Massachusetts-based Wyman’s, which has a processing plant in Cherryfield and other facilities in Washington County, claims in its lawsuit that the insurer misrepresented or misconstrued the insurance policy and violated Maine’s Unfair Claims Settlement Practices Act.
The lawsuit did not say how much of the claim has been paid and seeks all outstanding amounts and damages, including legal fees and costs.
