Court targets Gorham trash facility

A superior court judge has ordered a private trash and recycling facility in Gorham to stop accepting material after the company failed to remove unsafe piles of waste.

Cumberland County Superior Court Justice Thomas Warren ordered Roland Smalley, owner of Plan-It Recycling & Transfer Inc., to cease taking new trash as of Jan. 18, according to the Portland Press Herald. The company has been cited twice by the state Department of Environmental Protection and the town's code enforcement office for violating waste storage laws and failing to process or recycle piles of waste that were creating odors and posing a fire hazard. In November, Plan-It Recycling reached an agreement with the town to help pay for removal of 600 tons of waste but did not follow through, according to the paper.

Smalley said in an e-mail to the paper that the company is working to meet state and town regulations but did not specify a timeline. The company opened in 2004 and has 15 employees and 15 subcontractors.
