Judge approves Pike, Idexx agreement
A judge yesterday approved a settlement agreement between Pike Industries and Idexx that will allow the construction company to continue operating its Westbrook quarry, with limitations.
The consent order from Maine Business Court Justice Thomas Humphrey backs an agreement the two companies and the city reached in August that allows Pike to conduct eight blasts per year at its quarry near the Five Star Industrial Park, but also requires the company meet more than 40 performance standards, including limiting truck traffic and vibrations, according to the Portland Press Herald.
However, two companies who filed as interveners in the case -- Smiling Hill Farm and biopharmaceutical firm Artel -- could still appeal Humphrey's ruling to the Maine Supreme Judicial Court. The companies said Pike's blasting would interfere with their operations. In October, a residents group called the Birdland Neighborhood Alliance sued the city, arguing the agreement violates the city's zoning ordinance. That case is pending in Cumberland County Superior Court, according to the paper.
