Coffee By Design, the Portland-based coffee wholesaler and retailer, has accepted a settlement in a trademark infringement lawsuit the company filed last year against a Utah business.
The suit sought unspecified damages from 4Bush Holdings LLC of South Kaysville, Utah, and Desert Lake Group LLC of Cottonwood Heights, Utah, who have done business as CBD Coffee.
Under the settlement agreement, approved Friday in U.S. District Court in Portland, the defendants must cease using that business identity in all branding and must pay an undisclosed amount to Coffee By Design.
Coffee By Design co-founders and owners Alan Spear and Mary Allen Lindemann filed the suit in May 2019, claiming the CBD Coffee name created confusion in the consumer marketplace and associated their coffee with cannabidiol, a hemp derivative also known as CBD.
Spear and Lindemann, a 2019 Mainebiz "Woman to Watch," began their company in 1994 under its current name.
Besides a roastery and coffee house at 1 Diamond St. in Portland, the company has retail locations on Congress and India streets in the city, a location inside the L.L. Bean retail store in Freeport, and a private espresso and cold brew bar at IDEXX Laboratories headquarters in Westbrook, as well as hundreds of wholesale accounts from Maine to Japan.
