The Samoset Village Condominium Association is suing the adjacent Samoset Resort in Rockport for not upholding parts of its agreement with the 41 unit owners.
The condo association on Monday filed a lawsuit in Knox County Superior Court against Samorock LLC, alleging the company has failed to pay its agreed-upon portion of a new bathhouse at the condo village, according to the Herald Gazette. The former owners of the Samoset built the condo village on land adjacent to the resort in 1988 and signed an agreement detailing the entities' relationship, which has been amended over the years. The association's lawsuit claims Samorock failed to pay $46,321, its half of the construction of a new bathhouse at the village's outdoor pool, per the agreement. The lawsuit also alleges Samorock has prohibited condo residents from using the Samoset's recreational facilities, as allowed by the agreement, and that the company has denied the association access to its own financial records for 2008 and 2009, also a violation of the agreement.
The lawsuit asks the court to order Samorock to pay for its share of the bathhouse, allow condo residents access to the resort's pool and turn over financial records, according to the paper. Samoset General Manager Connie Russell did not comment on the lawsuit. The Samoset Resort was sold to Samorock LLC, an affiliate of Portsmouth, N.H.-based Ocean Properties, in 1999.
