Federal safety officials have cited North Yarmouth contractor Bowdoin Excavation Inc. for four violations connected to the death of a 23-year-old employee.
The U.S. Department of Labor's Occupational Safety and Health Administration also proposed $13,600 in fines for failing to meet certain workplace safety standards, including the use of protective equipment and the use of construction equipment on unsafe access roadways, according to the Bangor Daily News. In July, Danny Dodge was crushed by a backhoe while working on a natural gas line project in Bangor after the vehicle rolled down a short embankment. Dodge was wearing a hardhat, but the backhoe operator was not wearing a seatbelt, resulting in a $4,200 proposed penalty. OSHA also fined the company $1,800 for using a web sling that was damaged, another $1,800 for not putting a ladder in the excavation trench and $4,200 for operating the backhoe on a slope with a 32- to 40-degree grade.
A company representative told the paper it does not plan to contest the alleged violations, and that all employees, including the backhoe operator, were up to date with certifications and training. OSHA is still investigating the accident with plans to conclude it by the end of the month.
