Court rules against Saddleback in whistleblower case

Maine's highest court has ruled in favor of an electrician who was fired for blowing the whistle on illegal and dangerous work at the Saddleback ski resort in Rangeley.

The Maine Supreme Judicial Court yesterday upheld a jury's decision that found Saddleback liable for getting Robert Duggan Jr. fired in 2004 after he reported workers were installing electrical equipment for the resort's snowmaking system without a license. In its decision, the court said that Saddleback could be held liable for getting Duggan fired from his job at Integrity Electrical Installation and Service Inc. because the resort was "aiding, abetting, inciting, compelling or coercing another to penalize an individual."

Saddleback appealed a 2008 decision by the Androscoggin County Superior Court that found the resort had violated the whistleblower protection provisions of the Maine Human Rights Act and awarded Duggan $42,000 in damages, as well as his attorney fees.
