Mallinckrodt appeals HoltraChem ruling

As planned, Mallinckrodt officials have filed an appeal of an environmental clean-up plan for the former HoltraChem facility in Orrington.

In August, the Maine Board of Environmental Protection issued a final ruling on the former chemical processing plant site that ordered former owner Mallinckrodt to remove two of five landfills on the property. Company officials told the Bangor Daily News at that time that it would likely appeal parts of the ruling, and last Friday officially filed the appeal in Penobscot County Superior Court. In the 36-page appeal, Mallinckrodt calls for the court to throw out the order or take out requirements that it remove the second landfill, cap the other three landfills and perform other remediation tasks on a timeline established by the Department of Environmental Protection, according to the paper. The St. Louis-based company, which owned the plant from 1967 to 1982, says that removing the second landfill is not necessary and could expose residents to harmful chemicals.

The BEP ruling marks a middle ground between the company's and the DEP's proposals. The DEP in November 2008 ordered Mallinckrodt to excavate all five landfills, an order that the company appealed to the BEP. The remediation plan is estimated to cost between $100 million and $200 million. Mallinckrodt has already spent $40 million in cleanup efforts and announced in August it would invest another $100 million and begin work to remove the first landfill.
