Mass. contractor sues Quoddy Bay LNG

A Massachusetts engineering firm has sued Quoddy Bay LNG LLC, claiming it has not been paid for studies it did on the Oklahoma-based company's proposed natural gas pipeline in Washington County, according to an article from The Quoddy Tides.

Coler & Colantonio Inc., based in Norwell, Mass., filed a complaint in Washington County Superior Court alleging that Quoddy Bay LNG and its owners, Donald and Brian Smith, still owe the company nearly $160,000 for work it did on the company's proposed liquified natural gas pipeline between a proposed LNG terminal at Pleasant Point and the Maritimes & Northeast Pipeline in Princeton, according to the paper.

The lawsuit alleges that Quoddy Bay is "thinly capitalized and/or insolvent" and asks the court to "pierce the corporate veil" -- a legal term that means to bypass the corporation to reach personal assets -- and seize the Quoddy Bay LNG office in Perry and the former Lobster Crate restaurant on Route 190, which the Smiths jointly own, according to the paper. According to an April 2008 agreement between Quoddy Bay and Coler & Colantonio, other creditors are owed in excess of $2 million, the paper said.

Quoddy Bay LNG proposed a LNG terminal in Washington County in 2004, but last October withdrew its request for state permits after the Federal Energy Regulatory Commission dismissed Quoddy Bay's application because the company hadn't provided the agency with the required information. The company said at the time that it would refile its application in the future.
