MERC to pay injured worker $489K in damages

The Maine Energy Recovery Co. was ordered to pay a former employee $489,775 in damages for injuries he sustained during a routine shutdown of the now-shuttered waste-to-energy plant in 2009.

The Bangor Daily News reported a York County jury found in favor of Joseph Bordeau, a Mexico resident who worked as a contract welder for MERC. An orthopedic surgeon determined that Bordeau had a permanent back injury after a heavy metal debris pan came loose and swung on a chain, taking Bordeau from his perch on an 8-foot ladder and pinning him to an I-beam for several minutes.

Bordeau argued the company violated federal safety regulations by not properly rigging and hoisting the heavy debris pan.

The plant, then owned by Casella Waste Systems, closed in 2012 and was sold to the city of Biddeford for $6.5 million.
