Union-based Herbal Revolution Farm and Apothecary is among three tonic producers being sued by a Massachusetts company in federal court over a trademark dispute.
The Bangor Daily News reported that Springfield, Mass.-based Shire City Herbals filed the lawsuit in U.S. District Court in Massachusetts earlier this month. The lawsuit comes after a long dispute between the parties over Shire City’s 2012 trademarking of the term “fire cider.”
Shire City’s lawsuit alleges 10 counts of trade law violations, including trademark infringement, against the owners of Herbal Revolution Farm, Wildflower School of Botanical Medicine and Farmacy Herbs. The lawsuit has since prompted the defendants to launch an online petition to challenge Shire City’s trademark with the U.S. Patent and Trademark Office. The three parties argue that the term has been commonly used since the 1970s.
