MOOMilk sued over use of trademarked kosher symbol
Maine’s Own Organic Milk, a cooperative of local organic dairy farmers, is facing a lawsuit over its unauthorized use of a kosher symbol.
The Union of Orthodox Jewish Congregations of America last week filed the suit against MOOMilk in U.S. District Court in Massachusetts, arguing the company has infringed on its trademark “U” symbol, which indicates the group has certified a product as kosher, according to the Bangor Daily News. MOOMilk Executive Director William Eldridge admitted to the paper that the company has been putting the symbol on its milk cartons without paying an annual fee, and that the company hoped to settle the lawsuit out of court.
The Orthodox Union in December 2010 conducted an initial inspection of MOOMilk’s products, asking the company to file for annual certification and pay $5,500. The company said it couldn’t pay, citing financial struggles, and said it would cease using the symbol. According to the suit, MOOMilk continued to use the symbol without earning certification.
The suit asks the court to force MOOMilk to stop using the symbol and pay monetary damages.
