An oil dealer in southern Maine charged with failing to deliver fuel to more than 300 pre-paid customers must pay nearly $400,000 in restitution, a judge ordered last week.
York County Superior Court Justice G. Arthur Brennan approved an agreement that requires Nicholas Curro, owner of three Biddeford-area oil companies -- Price-Rite Oil, Veilleux Oil & Service and Perron Oil -- to pay $394,000 to 313 customers, according to the Portland Press Herald. Curro was also fined $250,000, which will be reduced to $25,000 if the restitution is paid within five years. The Attorney General's Office sued Curro in January 2009 for bilking customers out of pre-paid oil, and a judge last year ruled he violated the state's Unfair Trade Practices Act.
Dave Johnson, Curro's attorney, previously said his client may not "have the financial wherewithal to do anything" to reimburse customers, according to the paper. Curro's companies' assets were sold last year to repay secured creditors.
