A Bar Harbor hotel owner has taken his appeal of rival hotelier Tom Walsh's proposed $12 million hotel to Maine's highest court.
David Witham, doing business as the Witham Family LP, is appealing Hancock County Superior Court Justice Kevin Cuddy's decision to throw out his challenge of Walsh's project, according to the Bangor Daily News. In January, Cuddy ruled that Witham had no standing in his lawsuit, which claimed the project did not comply with a local land use ordinance and sought to revoke municipal approval. Walsh owns New Hampshire-based Ocean Properties, and his 110-room hotel on West Street was approved by Bar Harbor officials last April. Construction of the project began last fall, and the hotel is expected to open in spring 2012.
Though Witham's lawyer has filed a notice to appeal, the arguments are not due to be filed until May, according to the paper. Witham is Hancock County's biggest hotel owner with nearly a dozen properties in the region, including at least seven purchased in the last two years. Ocean Properties, which also has an office in Florida, operates more than 100 hotels and resorts in North America.
