Contractor sues marine transporter over rocky crossing

Thomaston-based Sawyer Brothers Inc. is accusing a Rockland marine transportation company of negligence that resulted in the contractor’s equipment receiving heavy damage during a turbulent crossing of Penobscot Bay.

The Bangor Daily News reported that the contractor filed a lawsuit against Island Transporter LLC and its vessel, Island Transporter, on Aug. 20 in U.S. District Court. In addition to equipment damage that was sustained during the turbulent December 2014 crossing of Penobscot Bay, the contractor said the ferry operator’s alleged negligence also made one of the contractor’s principals, Ryan Sawyer, fear for his life while he was in a truck on the ferry that rolled onto its side.

The contractor claims the ferry operator was negligent for deciding to operate despite reports of strong winds, for not providing the contractor’s two principals with lifejackets until after the turbulence and for not better securing the contractor’s vehicles. The contractor is seeking at least $50,000 in damages for lost profits, equipment damage and emotional distress.
