Court throws out appeal of Walsh hotel

A superior court has thrown out a lawsuit against hotelier Tom Walsh's planned 110-room hotel in Bar Harbor.

Hancock County Superior Court Justice Kevin Cuddy found that rival hotel owner David Witham had no standing in his suit claiming the project did not comply with a local land use ordinance, according to the Mount Desert Islander. Witham was protesting the Bar Harbor board of appeals' May refusal to revoke approval of the $12 million hotel, which received municipal approval in April. Witham is the county's biggest hotel owner with nearly a dozen properties in the region, including at least seven purchased in the last two years. Witham told the paper he is considering appealing the decision to the Maine Supreme Court.

New Hampshire-based Ocean Properties, Walsh's company, is expected to begin work on the hotel on West Street this winter and finish by the spring of 2012.
