DeLorme Publishing, the Yarmouth-based company that makes the Maine Atlas and Gazetteer, scored an important court victory this week in a patent infringement lawsuit, but its legal issues aren’t over yet.
The Portland Press Herald reported that a U.S. District Court judge on Thursday ruled that a patent held by Virginia-based BriarTek was not valid because there was evidence that multiple examples of similar products existed before the patent’s filing date. DeLorme is being sued by BriarTek for infringing its patent.
However, the newspaper noted, a similar patent infringement case between the two companies is still being decided by the U.S. International Trade Commission. The ITC levied a $6.2 million fine against DeLorme in July after a judge ruled that the company infringed on a patent held by BriarTek for DeLorme’s inReach satellite communications device. The ruling is being appealed by DeLorme.
While an attorney for DeLorme said the U.S. District’s Court ruling this week “mortally wounds” the ITC’s case, an attorney for BriarTek disagreed and said the ruling does not negate the violation, fine or consent order from the ITC.
