Dunlap wins second signature suit

A judge has ruled in favor of the secretary of state in a second court case surrounding the petition to overturn the state's tax reform law.

Kennebec County Superior Court Justice Donald Marden ruled last week that signatures verified by Secretary of State Matthew Dunlap are valid, according to the Kennebec Journal. Hallowell resident Charles "Wick" Johnson III filed a lawsuit against Dunlap in November, alleging at least 1,021 signatures deemed valid should have been found invalid due to collection methods, incorrect dates and clerical errors.

In his ruling, Marden acknowledged the decision could be moot, since he ruled last week in a separate suit filed by Republican Party Chairman Charlie Webster that Dunlap lost his authority to validate the signatures because he missed a 30-day deadline. But Marden opted to issue a ruling in the second case should the Webster case be overturned in appeal, according to the paper. Appeals to the Maine Supreme Judicial Court are planned in both cases, according to the paper.
