Two former employees of the Bangor-based Getchell Agency Inc. have filed a lawsuit against the company and its owner, Rena Getchell, for wages they claim they and nearly 100 fellow employees were not paid.
The Bangor Daily News reported the employees say they worked 24 hours a day, but were paid for only 16 while working for the business. Getchell Agency provides residential and support services to people with disabilities.
Frank T. McGuire, the attorney representing the company, told the paper that the agency fully denies the claims and plans to fight them in court.
The paper reported the claim filed July 3 in U.S. District Court seeks class action status, unpaid overtime wages, damages and a judgment against the agency and its owner for allegedly violating the Fair Labor Standards Act.
The dispute comes over whether the company is required to pay employees for hours during which they are asleep. McGuire said the claim that people should have been paid for those hours has no merit.
In 2010, the company signed a consent decree with the Department of Labor, admitting that it owed 88 employees back wages totaling $130,000 for unpaid overtime.
