Hotelier loses suit over Brunswick tax deal

A judge has ruled in favor of the town of Brunswick in a lawsuit over the town's approval of a tax rebate for a proposed inn at Maine Street Station.

Superior Court Justice Robert Crowley earlier this month ruled against Fairfield Inn & Suites owner Peter Anastos, who sued the town in March after it approved a credit enhancement agreement that will return nearly $1 million in property taxes to JHR Development for a proposed 54-room inn. Anastos, also principal owner of Maine Course Hospitality Group in Freeport, was seeking to make public a study the town used in approving the agreement. In issuing the ruling, Crowley said Anastos "simply wants the study to gain a business advantage," and that "releasing the study could result in a competitive disadvantage to JHR," according to The Forecaster.

Anastos told the paper he might appeal the decision, and that he still plans to move forward with a claim that the town didn't adequately consider how the tax break for JHR Development would adversely affect other hotel owners in the Brunswick region. Anastos was one of three people who filed a second lawsuit against the town in April arguing the tax break would take business from other hotels in the area, which are already struggling with high vacancy rates.
