Judge slaps T-Mobile facility over confidentiality rule

Wireless provider T-Mobile was wrong to require its workers not to talk about ongoing internal investigations to anyone but investigators, an administrative law judge for the National Labor Relations Board found.

The decision stems partly from a case at an Oakland call center, where a former employee represented by the Communications Workers of America filed a sexual harassment complaint and was asked to sign a confidentiality agreement, according to the Bangor Daily News.

The employee questioned the agreement, including possibly being terminated if found to have violated any portion of the terms.

Judge Joel Biblowitz wrote in his decision that a reasonable person could interpret the policy as limiting their legal right to discuss the terms and conditions of their employment, according to the BDN.

The order, issued Aug. 3, would require T-Mobile within 14 days to notify employees in Oakland and another facility in South Carolina that they can discuss pending investigations.

The company has until Aug. 31 to file a challenge to the order.
