Maine ex-carman sues Pan Am Railways

A former carman for Pan Am Railways in Waterville is suing the railroad in federal court, alleging that his former employer discriminated against him.

The Bangor Daily News reported that David Crockett of Skowhegan filed a complaint in U.S. District Court in Bangor last week, more than two years after he was placed on unpaid leave and said he could not afford visits to an expensive brain specialist — a stipulation set by Pan Am’s insurance provider as a condition before resuming work. The lawsuit said Crockett had been cleared by his medical provider to return to work after he allegedly refused an order to check off on rail cars that were not inspected, leading to his dismissal.

The Maine Human Rights Commission in March voted 2-2 to reject Crockett’s complaint that he was discriminated against for being a whistleblower. Pan Am had said that Crockett was previously disciplined for excessive absenteeism and not following a rail regulation before he was placed on unpaid leave in March 2012.

In the lawsuit, Crockett seeks reinstatement, back pay and benefits, among other damages.
