Multi-million-dollar pipeline fight likely heading to court
A U.S. District Court judge in Bangor has rejected a motion for summary judgment in the court case involving claims between Summit Natural Gas of Maine Inc. and Schmid Pipeline Construction Inc., setting the stage for the legal dispute to proceed in U.S. District Court.
The Portland Press Herald reported that the case stems from a lawsuit filed by Schmid in December 2013 seeking $72 million in damages from Summit for an alleged breach of contract and an underestimation of the scope of work involved in the Kennebec Valley pipeline project. Summit has filed counterclaims against Schmid, alleging breach of contract, breach of warranty and other claims, the newspaper reported.
U.S. Magistrate Judge John Nivison recommended against granting Schmid summary judgment on the breach of contract and prompt payment claim, the newspaper reported.
The two parties have until July 13 to file their responses to Nivison’s recommendations.
