Pike again opposing zoning change

The battle between Pike Industries and Westbrook officials will now be fought in Cumberland County Superior Court after Pike officials appealed the city council's decision to rezone the Five Star Industrial Park and limited the company's quarrying operations -- a move Pike attorneys say could jeopardize the business.

Attorney Tony Buxton of Preti Flaherty in Portland, who represents Pike, said the company is appealing the Westbrook City Council's June 7 decision to rezone the park as a manufacturing district, questioning its legality and claiming it conflicts with the city's comprehensive plan, according to the Portland Press Herald. Pike is asking the court to award compensation for lost use of the quarry, which could equal hundreds of thousands of dollars. The zoning change limits Pike's hours of operation and the frequency of its blasting, which city officials say will allow for more biotechnology, IT and financial services businesses to locate in the city, according to the paper.

In April, a Cumberland County Superior Court judge affirmed the Westbrook Zoning Board of Appeals ruling that Pike's quarrying operation in the industrial park is not exempt from zoning changes. Meanwhile, Pike and Westbrook officials are still working on an out-of-court settlement regarding the quarry operation.

A civil trial is scheduled for Sept. 13, according to the paper.
