Pike agreement sparks suit against city

A group of Westbrook residents yesterday filed a lawsuit against the city arguing that a recent proposed agreement allowing Pike Industries to keep operating its quarry violates the city's zoning ordinance.

In the suit filed in Cumberland County Superior Court, the Birdland Neighborhood Alliance claims the agreement reached by Pike, Idexx Laboratories and city officials creates a "spot zone" for the construction company, and that the city erred in approving the agreement "without going through the contract zone mechanisms under state law," the group's lawyer, David Lourie, told the Portland Press Herald. The August tentative agreement, which still needs court approval, would allow Pike eight blasts per year at the Spring Street quarry near the Five Star Industrial Park. Pike in July appealed the city council's decision to rezone the park to limit the company's quarry activities. Justice Thomas Humphrey last month postponed a trial on the case in order to review the consent agreement.

Artel, a company in Westbrook that makes laboratory technology, and Smiling Hill Farm have also spoken out against the consent agreement.
