A couple with a home on Goose Pond has won a $150,000 judgment against Bangor Hydro-Electric Co. after suing the company for having trees cleared from a nearby property.
The couple's complaint took issue with the company hiring a Freeport construction firm to remove trees on 4 acres of a 600-acre parcel adjacent to the couple's property along Route 1A in Dedham, according to the Bangor Daily News.
The couple, Christian and Tonya Andersen, argued that the company violated restrictions on how the land can be used by clearing the trees and using it as a staging area for construction materials, that runoff from the site would adversely affect water quality at Goose Pond and that their property now gets more light and noise from the highway.
The couple's initial complaint estimated the value lost on their property to be $1.5 million.
After that decision, the court is still considering whether any remediation including replanting trees or environmental remediation should be ordered.
