Casella in talks to sell MERC

The developer of the $100 million Saco Island project is in talks to buy the Maine Energy Recovery Co. incinerator in Biddeford and shut it down.

Mattson Development LLC of Winthrop has been discussing "a number of options" with Rutland, Vt.-based Casella Waste System, including purchasing and shuttering the controversial trash incinerator plant, but have not reached a specific agreement, according to a statement from Mattson COO Bob Martin. The city of Biddeford and Casella last year signed a five-year contract in which both parties agreed to work cooperatively to shut down the incinerator.

Meanwhile, former Saco Mayor Mark Johnston yesterday said he has filed a nuisance lawsuit against MERC in York County Superior Court for its offensive odor, saying "the plant remains a distinct threat to realizing the full potential of economic revitalization in downtown Biddeford-Saco," according to an email he sent to Gov. John Baldacci and members of the media. His lawsuit calls for the Department of Environmental Protection to enforce the odor protocol currently in place, but which he says does not work.
