The Maine Supreme Judicial Court yesterday rejected a citizens' group appeal of a wind farm in the Lincoln area and upheld a state law that expedites permitting for wind farms.
The court reaffirmed state approval yesterday of a $130 million wind farm and disagreed with Friends of Lincoln Lakes' arguments that state environmental regulators ignored the farm's impact on wildlife, according to the Bangor Daily News. The court also supported the constitutionality of a state law that fast-tracks approval for alternative energy sources. In February, the group lost an appeal of the Lincoln Planning Board's approval of the project, and has a separate appeal of that decision pending in Maine Supreme Judicial Court.
The 40-turbine Rollins Mountain project by Evergreen Wind Power III LLC, a subsidiary of Massachusetts-based First Wind, received approval from the Maine Department of Environmental Protection in April 2009. The company said construction of the farm would not happen soon, and that it's currently seeking investors.
