High court finds favor with mountain wind farm
A 14-turbine wind farm proposed for Passadumkeag Mountain in Penobscot County is moving forward after Maine's highest court upheld its approval by the citizen-led Board of Environmental Protection.
The Bangor Daily News reported the the state's Supreme Judicial Court issued the decision Tuesday, disagreeing on the two main points made by the Passadumkeag Mountain Friends group, which sought to appeal the project's approval.
The group had said that the citizen-led board should have deferred to the Maine Department of Environmental Protection, which rejected the project last year, saying it would have an adverse impact on the area's scenery. The group also said that BEP members erred in speaking privately with company officials.
However, the high court found no weight with those arguments, saying that the BEP has the right to overturn the state's original decision with its own evidence because it can serve as both a fact-finder and decision-maker.
The wind project is being developed by Houston-based Quantum Utility Generation.
