Judge reconsiders Hannaford civil lawsuits

Hannaford customers have another chance to seek compensation from the supermarket chain for the time and effort necessary to smooth their financial situation in the wake of the 2007-2008 data breach that exposed 4 million credit card numbers to fraud.

Judge D. Brock Hornby threw out the civil cases in May, claiming the hassles were "the ordinary frustrations and inconveniences that everyone confronts in daily life with or without fraud or negligence." But he has reconsidered his decision and sent the case to the Maine Supreme Judicial Court for its opinion, according to the Portland Press Herald. The case has no precedent in Maine, where law requires a way to attach a monetary value to a claimed loss, so a decision in favor of the consumers "would be a major advance in the law," Peter Murray, the Portland lawyer who is lead attorney for the plaintiffs, told the paper. The plaintiffs will seek class-action certification if they receive a favorable decision.

There was no comment from Hannaford Bros. Co.'s attorneys on the new development.
