Lawsuit over First Wind turbine noise dismissed

The Maine Supreme Judicial Court has dismissed a case brought by a Mars Hill resident against Massachusetts-based First Wind that alleged noise from the company’s nearby wind farm induced stress.

The Maine Public Broadcasting Network reported the Maine Supreme Court upheld a lower court’s ruling in dismissing the case brought forward by Michael Gosselin, a disabled veteran with post-traumatic stress disorder. Gosselin claimed noise from the turbines 1.7 miles away gave him stress and that he has since built a noise-dampening bunker in his garage. In his suit, he sought to have the company buy his property for fair market value.

The station reported Gosselin was not included in a First Wind settlement with 18 neighboring landowners last year because he was judged to be too far from the turbines.
