The Maine Attorney General’s Office plans to ask a federal court to order the reinstatement of certification for the 92-bed Riverview Psychiatric Center in Augusta in an effort to restore millions in federal funding Riverview lost when its federal certification was pulled last September.
The Portland Press Herald reported that the latest action follows the state’s unsuccessful appeal of a January decision by an administrative law judge with the Centers for Medicare and Medicaid Services. The state’s appeal was denied on Aug. 4, the newspaper reported, citing information it obtained through a Freedom of Information request.
Timothy Feeley, spokesman for Attorney General Janet Mills, told the newspaper in a written email that it “wasn’t entirely unexpected” the appeals board would back up the law judge’s decision, “since they often uphold the department’s own rulings.”
Last month a regional CMS administrator told the newspaper that Maine will be required to repay the federal government millions of dollars it has used to run Riverview Psychiatric Center during the past year following its decertification.
