A citizens' group opposed to a $130 million wind farm on Rollins Mountain has lost another appeal.
The Maine Supreme Judicial Court yesterday upheld a lower court's ruling that Friends of Lincoln Lakes did not provide the proper legal identification to the Lincoln Appeals Board and therefore could not appeal the town's approval of the project, according to the Bangor Daily News. In January 2009, the Lincoln Appeals Board voted 4-2 to deny the group the ability to appeal the planning board's approval of the project, a decision upheld this February by the Maine Superior Court.
The Supreme Judicial Court in March rejected a separate appeal by the group and reaffirmed the Maine Department of Environmental Protection's approval of the wind farm. The DEP approved the 40-turbine wind farm in April 2009.
First Wind, the developer behind the Rollins Wind farm in northern Penobscot County, said in a statement that the project will now move forward, with construction happening in the coming months.
