Tax reform question on June ballot

A Hallowell resident who lost a case against the secretary of state will not appeal the decision, opening the door for voters to decide the fate of the tax reform law in June.

John Paterson, the lawyer for Charles "Wick" Johnson, said his client will not appeal a decision issued last week that all signatures verified by the secretary of state in the people's veto effort of the law were indeed valid, according to the Kennebec Journal.

The question will now appear on the June 8, 2010 ballot, despite the fact that the Secretary of State's Office has not yet decided whether to appeal a decision in a separate but related case, Deputy Secretary of State Julie Flynn told Mainebiz. That decision found that Secretary of State Matthew Dunlap lost his authority to certify the signatures because he missed the 30-day deadline, and ordered the question to go on the ballot. An appeal on that case would only involve Dunlap's authority to verify signatures, and would not keep the question off the June ballot, Flynn said.
