Widow wins $6.7M in suit against EMMC

A jury in Penobscot County has awarded a widow more than $6.7 million in her suit against Eastern Maine Medical Center and a Bangor surgeon, which appears to be among the largest ever awarded by a Maine jury in a medical malpractice case.

Paula Braley of Lee filed the suit in 2009 over the death of her husband, Thomas Braley Sr., at EMMC in May 2005 following an ATV accident, according to the Bangor Daily News. The jury found EMMC and Dr. Lawrence Nelson negligent in the man's death by failing to follow up on indications of internal bleeding.

Superior Court Justice William Anderson is expected to reduce the award, as damages for suffering and loss of companionship and emotional distress were capped by the Legislature at the time of Braley's death to several hundred thousand dollars.
