Lawyer wins appeal in 'robo-signing' cases

Maine’s highest court has ordered the removal of a reprimand against a Portland lawyer who was connected to a scandal involving the “robo-signing” of foreclosure documents.

The Bangor Daily News reported that Paul Peck, a lawyer at Drummond & Drummond, will have his reprimand removed after a Maine Supreme Judicial Court judge found that a panel for the Maine Board of Overseers of the Bar erred in saying Peck violated bar rules. Peck filed for an appeal of the reprimand last May.

The panel last April had accused Peck of failing to take "immediate and effective action” after learning in 2010 that a GMAC Mortgage employee, who was a client of Peck’s, was signing thousands of legal documents to foreclose on people's homes without first checking to assure the documents were accurate and without having the papers authenticated.

Justice Andrew Mead said the “panel’s decision is founded upon a ‘should have known’ standard than actual knowledge,” adding that “the distinction is critical.”
